The SEMA Award Rules and Regulations
The SEMA Award Contender Contest
NO PURCHASE NECESSARY TO ENTER OR WIN.
OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE AT LEAST 18 YEARS OF AGE AND WHO HAVE A VALID EMAIL ADDRESS. VOID WHERE PROHIBITED.
Employees and their immediate families (i.e., parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households (whether or not related) of Specialty Equipment Market Association ("SEMA" or "Sponsor") and its respective parents, subsidiaries, dealers, service agencies, independent contractors, advertising and promotion agencies, web hosting and service and fulfillment providers are not eligible to enter or win. SEMA member companies and SEMA Show exhibiting companies are encouraged to participate. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this contest. Contest is subject to all applicable federal, state and local laws.
SEMA is giving consumer enthusiasts the chance to show off their vehicles in the 2011 SEMA Show (Owner must be able to deliver the vehicle to the 2011 SEMA Show. Owner responsible for transporting vehicle to and from the SEMA Show in Las Vegas, Nevada; Vehicle to arrive Monday, October 31, and may be removed after show hours on any day between Tuesday, November 1 – Friday, November 4). Winners also receive guest credentials for two (2) to attend the 2011 SEMA Show; The SEMA Show is a trade-only event not open to the general public, along with two (2) nights hotel accommodations in Las Vegas at an official SEMA Show host hotel (check in Monday, October 31, 2011; check out Wednesday, November 2, 2011) and a $50 gas card.
The contest begins at 12:00 a.m. Pacific Time (“PT”) on September 13, 2011 and ends at 11:59 p.m. PT on October 2, 2011 (“Contest Period”).
To enter, the video simply needs to meet the following criteria:
- Submit a 60-90 second video showcasing your modified vehicle
- Vehicle must be a current generation model of one of the 39 SEMA Award contenders
- Vehicle must be registered and street-legal
- Winning video will include a vehicle walk around pointing out and describing the vehicle year, make and model; and type, brand and benefits of aftermarket products/parts installed
- A minimum of three different branded aftermarket products must be highlighted
- Industry experts will select the vehicles that will be featured at the Show, based on several factors, including:

◦ Online likes/fans
◦ Modifications highlighted and described benefits of the products
◦ Expert opinions of the vehicle
During the Contest Period, visit http://www.semashow.com/semaaward, and follow the directions to complete and submit the entry form. All entries must have completed the form here (including uploading the video), and they must be received by 11:59 p.m. PT on October 2, 2011 to be eligible. Eligible entrants must submit the requested entry information in accordance with these official rules. No other method of submission will be accepted. Entries generated by script, macro or other automated or mechanical means or by any means which subvert the entry process are void. All entries (including the video) become the property of Sponsor and will not be acknowledged or returned. By submitting a video to this contest, you grant to SEMA a perpetual royalty-free license to copy, distribute, modify, display and perform publicly and otherwise use, and authorize others to use, your video for any educational purpose throughout the world and in any media.
Videos must not contain violence, profanity, sex, images of a crude nature, or direct attacks on individuals or organizations. SEMA will disqualify any entries it deems to contain offensive material.
The video must be your own original creation and must not infringe on any third party rights. Entrants are responsible for obtaining all necessary permissions. No copyrighted music, video, or images may be used in submissions to this contest without appropriate permission.
SEMA reserves the right to not select a winner if none of the entries received are judged to be high quality based on the Contest Rules and Eligibility requirements.
Winners receive a space to display their vehicle at the 2011 SEMA Show and guest credentials for two (2) to attend the 2011 SEMA Show; The SEMA Show is a trade-only event not open to the general public, along with two (2) nights hotel accommodations (one room, double occupancy) in Las Vegas at an official SEMA Show host hotel (check in Monday, October 31, 2011; check out Wednesday, November 2, 2011) and a $50 gas card. Winners will need to be able to bring winning vehicles to the SEMA Show on Oct. 31, 2011 in Las Vegas, Nevada. Approximate Retail Value (“ARV”) of Prizes: $500. Trip must be taken on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to such winner. Sponsor reserves right to change dates. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18), unless the child or legal ward of winner and must sign a liability/publicity release prior to issuance of travel documents. If guest is child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward. If winner is at least 18 but still considered a minor in his/her jurisdiction of residence, a parent/legal guardian may be required to accompany winner on trip as his/her guest. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including additional transportation, meals, souvenirs, and gratuities are the sole responsibility of the winners. If, for whatever reason, Sponsor is unable to provide any element of the trip, no compensation or substitution will be provided; however, remainder of prize package will be awarded and Sponsor will have no further obligation to winner. Winners may not substitute, assign or transfer a prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor’s sole discretion.
Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
LIMITATIONS OF LIABILITY:
Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered, or garbled messages, notifications or entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the contest, the processing of entries, the announcement of the prizes, or in any contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the contest. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this contest or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the contest or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the contest (or any portion thereof) should any portion of the contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries. If terminated, Sponsor may, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Entrants, by participating, agree that Sponsor and their respective parents, subsidiaries, divisions, affiliated companies, dealers, service agencies, independent contractors, advertising and promotion agencies, web hosting and service and fulfillment providers, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize (including any travel or activity-related thereto) or participation in this contest.
As a SEMA Show exhibitor, the Entrant and any personal guests, representatives, assigns, heirs and next of kin (herein referred to as "Exhibitor") hereby releases, waives, discharges and covenants not to sue the Las Vegas Convention and Visitors Authority, the Specialty Equipment Market Association, ConvExx, their directors, officers, employees, agents, representatives, servants, licensees, invitees, patrons, guests or contractors (herein referred to as "Releasees") and each of them, from all liability to Exhibitor for any and all loss or damage and any claim or demands therefore on account of injury to the person or property or resulting death of Exhibitor arising out of or relating to the SEMA Show, whether caused by the negligence of the Releasees or otherwise. Exhibitor hereby agrees to indemnify, save and hold harmless the Releasees and each of them from and against any loss, liability, damage or cost Releasees may incur from any and all claims, demands, actions, causes of actions, penalties, judgments and liabilities of every kind and description (including court costs and reasonable attorneys’ fees) for injury to or any death of persons, and damage to and loss of property which are caused by, arise from or grow out of the acts or omissions of Exhibitor incident to the SEMA Show, or from any breach by Exhibitor of any term or condition of this Agreement. Exhibitor hereby assumes full responsibility for any risk of bodily injury, death or property damage arising out of or related to the SEMA Show, whether caused by the negligence of Releasees or otherwise. Exhibitor hereby agrees that this Release and Waiver, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by Releasees and is intended to be as broad and inclusive as is permitted by the laws of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
This contest shall be governed by and interpreted under the laws of the State of California, U.S.A. without regard to its conflicts of laws provisions. Entrants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this contest or these Official Rules shall be resolved, upon the election by entrant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the Judicial Arbitration and Mediation Services, Inc. (“JAMS”) or the American Arbitration Association (“AAA”), as selected by the Sponsor. In addition to JAMS or AAA, Claims may be referred to any other arbitration organization that is mutually agreed upon in writing by entrant and Sponsor, or to an arbitration organization or arbitrator(s) appointed pursuant to Section 5 of the Federal Arbitration Act, 9 U.S.C. Sections 1-16, provided that any such arbitration organization and arbitrator(s) will enforce the terms of the restrictions on arbitration provision set forth below. IF ARBITRATION IS CHOSEN BY ANY PARTY WITHRESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT ORHAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THERIGHTTO PARTICIPATE IN REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OROTHERPERSONS SIMILARLY SITUATED, OR AS MEMBER OF ANY CLASS OF CLAIMANTSPERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration. Notwithstanding any other provision in these Official Rules and without waiving either party’s right to appeal such decision, should any portion of this provision be deemed invalid or unenforceable, then the entire provision (other than this sentence) shall not apply.
